The sentencing phase of Brian Stearns’ trial was postponed last Thursday in Austin by Federal District Judge James R. Nowlin. Nan Hazel, an attorney from the George and Davidson law firm in Austin, said that the judge has set a new date for 9:30 a.m. Thursday, July 12. Steans was convicted on 80 counts of fraud in Judge Nowlin’s U.S. District Court, Western District of Texas in Austin last February. Ms. Hazel told the Standard-Herald that a similar type case involving Russell Erxleben was delayed five times. Erxleben had the same defense attorney as Stearns, she said. “Erxleben, who also was convicted for fraud, was finally sentenced on the sixth hearing,” she said.
